What truly defines ownership in Kenya ? Is it the title you hold, or the history behind it? In Dina Management Limited v County Government of Mombasa & 5 others (2023), the courts firmly answered this by emphasizing that ownership depends on the legitimacy of the root title, not just registration.

The court held that even where property has changed hands, a title acquired through an illegal or irregular process cannot be protected and a buyer must go beyond documents to verify how the property was first allocated.
